Date: Effective from the 27th Sep 2011 (as per TRAI).
The Telecom Regulatory Authority of India (TRAI) said that the subscribers registered under the NCPR or 'Do Not Call Registry', would not receive any unwanted calls and text messages from the telemarketing companies. The order would be effective from September 27, 2011.
What does it say?
All messages sent by an enterprise will be segregated in two categories: Transactional and Promotional messages. TRAI has provided specific definitions for these categories as explained below. For each category of messages, separate and unique accounts will be configured.
What is a Transactional Message?
1. Information sent to its customer(s) by the Bank or Financial Institution or Insurance Company or Credit Card company or Access Provider pertaining to the account of that customer(s);
2. Information given by Airlines or Indian Railways or its authorized agencies to its passengers regarding travel schedules, booking and reservation;
3. Information from a registered Educational Institution to parents or guardians of its students;
4. Any other message as may be specified by the TRAI, from time are considered “Transactional Messages” and sent to all mobile subscribers irrespective of whether they are on the NDNC /NCPR registry.
Currently, any messages not in the list above would be classified as ‘Promotional’ messages. As and when TRAI issues further clarification on allowable ‘Transactional’ messages, ICS will amend its policies accordingly.
What is a Promotional Message?
All message(s) containing promotional material or advertisement of a product or service. Promotional SMS can be pushed only between 9 am to 9 pm and not during other hours. Also, every promotional SMS sent should contain unique SMS header irrespective of the product/brand being promoted.
All promotional messages will be subject to DND scrubbing.
Why adherence is mandatory?
TRAI has established stiff penalties. On first complaint from the subscriber, the service provider (eg. ICS) will be levied a penalty of Rs 25,000. This penalty rises in steps upto 2.5 lakh for the sixth complaint. We will be required to collect from the infracting enterprise. Additionally, after 6 complaints TRAI will suspend the entire application of ICS for a period of 2 years.
